Contract & Agreements
Cost Plus contracts and/or Fixed price contracts are provided by Michael Downing Constructions for all building works. The contracts are supplied by the Housing Institute of Australia (HIA) of which we are a member.

Payment Terms
Upon a written contract being entered into, the following payment terms apply:
- Initial deposit to be paid prior to building works commencing
- (10% for works under $20,000 & 5% for building works over $20,000)
- Invoices for works to be submitted as per payment schedule, or weekly for Cost Plus Contracts
(this will be provided with your copy of the contract) - Payment is to be made within 5 working days of each invoice
- Method of payment is by direct deposit and/or cheque
- Payment via direct deposit and cheque is to be cleared within the 5 days from the date of invoice
- Final invoice payable on completion of all works
All payment details are subject to the Building and Construction Industry Security of Payment Act 1999 NSW. This act can be viewed at the Department of Commerce Website www.dpws.nsw.gov.au
Insurance Details
Home Warranty Insurance
All residential building works over the value of $12,000 require Home Warranty Insurance. This is legally required under the Home Building Act 1989. The cost of this insurance will be outlined in the quotation/contract and a copy provided to the client.

Consumer Information
Builders Licence
The Department of Fair Trading are a government organisation that provide consumers with information on building services. One of the important features of the DOFT is there licence check facility.
This facility allows you to complete a licence check online. They recommend that consumers complete a licence check before entering into a contract with a builder to ensure that you only deal with a licensed builder.
